1.      Definitions/ Interpretation:

 

1.1   The terms we, us or our is referring to Heat Shift Air Conditioning pty ltd, the terms you, your or customer refers to the person identified in the quotation/engaging in our services.

1.2   Quote or Quotation means a written or verbal description of goods or services

1.3   Warranty refers to a set period of time where, costs are covered by either the manufacturer or us in the event of a particular problem / failure. And is bound by these terms and conditions.

1.4   Manufacturer refers to the business or company that supplies us with goods such as materials or equipment.

 

 

 

 

 

 

 

 

2.      Engaging in Heat Shift Air Conditioning pty ltd services.

 

By you, giving consent to proceed in agreement to a Quotation either verbally or in writing via email correspondence, you agree to all terms laid out by “Heat Shift Air Conditioning pty ltd” and enter a legally binding contract.

 

2.1   “Heat shift air conditioning pty ltd” reserves the right to amend or retract a quotation in writing and give a minimum 5 days’ notice as required due to unforeseen circumstances and/ or any amendments required.

2.2   By You agreeing to the quotation and/ or call out fees verbally or writing means you are to pay the amount in full within 7days of the invoice date, to the nominated account, unless otherwise directed by us.

2.3   Any unforeseen issue arising during installation may result in a stop work and extra precautions or further quotations for rectification that will be payable by the customer. Including but not limited to Electrical issues, safety concerns, any required unforeseen switchboard upgrades or alterations, discovery of asbestos, vermin/snake impeding access, unforeseen issues arising from installation site which could include but not limited to impenetrable walls, drainage issues or an unsuitable structure.

2.4   Whilst all due diligence is taken to check componentry, some parts cannot be tested properly in the circuit/ system for many reasons. For this, all quotes have no guarantee on other faulty components or parts, and upon paying deposit the customer agrees any further repairs required will be quoted and replaced at the customer's expense.

2.5   After a design/quotation has been accepted by the customer, any alterations by the customer will incur an extra cost/fee relevant to the alteration required.

2.6   After installation has been completed or during installation, any change of mind of the customer relating to any of the installation may incur an extra cost/ fee relevant to the required change. All outstanding charges will be payable prior to the alteration taking place.

2.7   After you accept a quotation, we have a no returns policy on materials or parts that have been ordered. Regardless of if you change your mind at any stage.

 

 

 

3.       Payment Terms

By you, giving consent to proceed in agreement to a Quotation either verbally or in writing via email correspondence, you agree to all terms laid out by us and enter a legally binding contract.

 

 

3.1   Payment is to be made in full, 7 days after the invoice date, late payments or failure to pay, may result in us, engaging the services of a debt collection agency. We may seek legal action to recover all relevant fees including but not limited to lost time associated in the collection of the monies owed by you, the customer.

3.2   All equipment, parts and materials remain the property of Heat Shift Air Conditioning pty ltd until all monies are paid in full to the nominated account.

3.3   Any payment over $500 AUD will incur a 1.9% fee using our credit card/ eftpos facility.

3.4   Direct transfer of invoice to the nominated bank account incurs no extra fee.

 

 

 

 

 

 

 

 

 

4       Warranty Terms

 

By you, giving consent to proceed in agreement to a Quotation either verbally or in writing via email correspondence, you agree to all terms laid out by us and enter a legally binding contract.

 

4.1   New Heating, cooling or refrigeration system installations come with a 5 year workmanship warranty covered by us. This strictly and only includes issues relating to the installation of such equipment and does not include faulty equipment or materials. Each manufacturer has its own standard warranty period which covers its own equipment and is generally laid out in our quotations although sometimes omitted.

4.2   When engaging Heat Shift Air Conditioning pty ltd in a warranty call out, if we deem the issue to not be warranted. It is up to our discretion whether or not a charge will be billed to the customer.

4.3   We will not warrant our installation if it has been altered in any way by anyone other than a Heat Shift Airconditioning pty ltd representative.

4.4   If a company/ technician other than Heat Shift Air Conditioning pty ltd has worked on the system/s and we deem this to be the cause of a defect, this will not be covered by our warranty.

4.5   Our Repairs/Parts are covered by a manufacturers warranty of 12 months, unless otherwise stated or the terms of the warranty have been voided.

4.6   We reserve the right to attend to a warranty call at the earliest possible convenience to us. We always intend to attend promptly, however sometimes there may be lengthy delays that may be unavoidable and out of our control.

4.7   We will not cover/ warrant issues caused but not limited to, weather, poor maintenance, electrical issues, foreign objects, misuse, original design/ installation alterations, war, acts of God.

4.8 Noise from a system if within manufacturers specs will not be considered a warranty issue. nuisance calls from noise complaints that are considered normal operational noise may be billed to the customer at our discretion.
